The Protection of Your Personal Data is Important to Us

We at Agensi Pekerjaan Permit Pro Consultancy Sdn. Bhd., Permit Pro Services Sdn. Bhd. and its related entities (“we”, “us” or “our”) are committed to protecting your personal data and respecting the privacy of individuals. This Personal Data Protection Notice (“Notice”) sets out how we collect, process, store, disclose and protect your personal data in accordance with the Personal Data Protection Act 2010 (“PDPA”) and ensure that any personal data we collect about you is treated with the appropriate degree of protection and confidentiality.

By continuing to access our website, using our products and services, engaging with us over the phone, via email, in person or by any other means, or when you voluntarily provide your personal data to us, you warrant that you are at least 18 years of age and consent to our collection, storage, use and disclosure of your personal data as described in this Notice.

What Personal Data Do We Collect?

The personal data that we may collect from you for the purposes listed below includes but is not limited to: 

  • personal identification information such as name, age, NRIC or passport number, gender, date of birth, marital status, nationality, place of birth, mother’s maiden name, personal document details (i.e. visa, work permit) 

  • contact information such as residential address, email address, telephone number

  • career history such as employer information, job description, skills records, date of employment, remuneration and benefits, work location details

  • educational background such as education level, academic records

  • images (still/recording) / photo

  • information on your spouse, child and/or other family members, where applicable

  • payment-related information such as billing details and transaction amount

  • other information we collected from your interaction with us and use of our website
     

(collectively referred to as the “personal data”)

Where you provide personal data of any third party to us, consent is deemed to have been given to us to process and disclose the third-party individual’s personal data.

We may collect certain payment-related information necessary to facilitate transactions, such as your name, billing details and transaction amount. However, we do not collect, process or store sensitive financial information such as your credit or debit card numbers or banking credentials. All payment transactions are securely processed by our third-party payment gateway service provider, Billplz Sdn. Bhd. These third-party payment gateway service providers are subjected tpoliciesr own respective privacy policy available on their website.

You acknowledge that you provide the personal data to us voluntarily. Where it is indicated that it is mandatory for you to provide your personal data to us, failure to provide such information may result in us not being able to perform our services.

Why Do We Collect Personal Data?

We will collect and process your personal data to (where applicable):

  • provide immigration support, visa and/or consular services

  • provide advice and consultation on all application matters, procedures, requirements and general consultation in relation to the provision of services

  • prepare, arrange, coordinate and manage online and offline applications, information and documents with the relevant approval agencies, regulatory bodies and/or visa issuing authorities.

  • liase and communicate with you with regards to the provision of services including reporting requirements and reminders on application status and provide regular updates and latest developments on applicable rules and guidelines

  • provide and coordinate support services such as despatch services  

  • process and facilitate payment related transactions through third-party payment gateway service providers

  • comply with applicable legal, regulatory and contractual obligations

  • maintain internal records for administrative, audit and reporting purposes
     

(collectively referred to as the “purposes”).

How Do We Collect Personal Data?

We will only collect personal data by lawful and fair means. We collect personal data from time to time, when you fill up documents physically and/or electronically, liase with us or our consultants, or when you voluntarily give it to us in person, over the telephone, through websites, supporting documents or from third parties you have consented to.

By providing your personal data to us, you consent to us processing your personal data in accordance with this Notice, and you confirm that all personal data provided by you is accurate and complete, and that none of it is misleading or out of date. You will promptly update us in the event of any change to your personal data. 

Consequences of Not Providing Us Your Personal Data?

Although you are not obliged to provide us with your personal data, we will not be able to fulfil the purposes set out in this Notice, including but not limited to, providing you with our products or services or fulfil our contractual and/or legal obligations if you fail to provide all requested information.

How Do We Keep Your Information Secure?

The protection of your personal data is important to us. We take the security of your personal data seriously and implement appropriate technical and organization measures to protect it against loss, misuse, unauthorised access, disclosure, alteration or destruction in accordance with the PDPA.

How Long Will Your Personal Data Be Retained?

We will retain your personal data only for as long as is necessary to fulfil the purposes for which it was collected or for any other lawful purposes. The retention period will also consider applicable legal, regulatory, tax, accounting or operational requirements. Upon the expiry of the retention period and/or once your personal data is no longer required for these purposes and in accordance with contractual requirements, we will take reasonable steps to ensure that it is destroyed, deleted, anonymised or otherwise permanently removed from our systems.

 

Disclosure to Third Parties

Your personal data may be disclosed to the Immigration Department of Malaysia (JIM), approving bodies like the Ministry of Tourism, Arts and Culture (MOTAC), Malaysian Investment Development Authority (MIDA), Central Bank of Malaysia (BNM), Civil Aviation Authority of Malaysia (CAAM), Companies Commission of Malaysia (SSM), Inland Revenue Board (LHDN), government agencies and embassies for the purposes set out in this Notice.

We may disclose your personal data to third parties where it is necessary for the purposes set out in this Notice. Such third parties may include third party payment gateway service providers and any other service providers engaged by us to perform services on our behalf. We will take reasonable steps to ensure that such third parties process your personal data only for the purposes for which it was disclosed and in accordance with applicable data protection laws and appropriate confidentiality and security obligations.

We may also disclose your personal data where such disclosure is required under the law, court orders or pursuant to guidelines issued by regulatory or other relevant authorities, if we reasonably believe that we have a lawful right to disclose your personal data to any third party or that we would have had your consent for such disclosure if you had known of the same, and/or if the disclosure is in the public interest.

Transfer of Personal Data Outside of Malaysia

Your personal data may be transferred to, stored in, or accessed from locations outside of Malaysia, where necessary for the purposes set out in this Notice by our service providers. Where such cross-border transfers occur, we will take reasonable steps to ensure that your personal data continues to be protected in a manner consistent with the requirements of the PDPA and appropriate contractual, organizational and technical safeguards are implemented to protect your personal data. Such transfers will only be carried out where permitted under applicable laws and for the purposes disclosed in this Notice.

Your Rights as a Data Subject

Under the PDPA, you are entitled to the following rights:

a) Right of Access

You have the right to request access to, and a copy of your personal data held by us.

 

b) Right to Correction

You have the right to request to update or correct your personal data held by us.

 

c) Right to Withdraw Consent

You have the right to withdraw your consent for the processing of your personal data, subject to applicable laws. If you withdraw your consent for us to process your personal data, we may be unable to continue providing our services to you.

 

d) Right to Prevent Processing

You have the right to request that we stop processing your personal data for a specific purpose.

 

e) Right to Data Portability

You have the right to request us to transfer the personal data you have provided to another organization.

Amendments To This Notice

We reserve the right to update and amend this Notice from time to time. Any amendments to this Notice will be posted on our website.

In accordance with Section 7(3) of the PDPA, this Notice is issued in both English and Bahasa Malaysia. In the event of any inconsistencies or discrepancies between the English version and the Bahasa Malaysia version, the English version shall prevail.
